By accessing this website, or by contracting with us for service, you agree, without limitation or qualification, to be bound by this policy and the terms and conditions it contains, as well as any other additional terms, conditions, rules or policies which are displayed to you in connection with this service/website.
The purpose of this AUP is to comply with the relevant laws of the Republic; to specify to customers and users of our service/website what activities and online behaviour are considered an unacceptable use of the service/website; to protect the integrity of our network and to specify the consequences that may flow from undertaking such prohibited activities.
This document contains a number of legal obligations which you are presumed to be familiar with. As such, we encourage you to read this document thoroughly and direct any queries to our customer services/legal department at +27-10-500-1414.
Izwi respects the rights of our customers and users of our services to freedom of speech and expression; access to information; privacy; human dignity; religion, belief and opinion in accordance with our constitution. We undertake not to interfere with any of those rights unless required to do so by law; unless those rights are exercised for unlawful purposes; or unless the exercise of those rights threatens to cause harm to another person or affect the integrity of our network.
ISPA membership and Code of Conduct
Izwi confirms that in compliance with section 72 of the Electronic Communications and Transactions Act 25 of 2002, Izwi is a member of the Internet Service Providers' Association (ISPA) and has adopted and implemented the association's official Code of Conduct, which can be viewed at http://www.ispa.org.za/code.
Izwi's services/website may only be used for lawful purposes and activities. We prohibit any use of our website/network including the transmission, storage and distribution of any material or content using our network that violates any law or regulation of the Republic. This includes:
Any violation of local and international laws prohibiting child pornography; obscenity; discrimination (including racial, gender or religious slurs) and hate speech; or speech designed to incite violence or hatred, or threats to cause bodily harm.
Any activity designed to defame, abuse, stalk, harass or physically threaten any individual in the Republic or beyond its borders; including any attempt to link to, post, transmit or otherwise distribute any inappropriate or defamatory material.
Any violation of Intellectual Property laws including materials protected by local and international copyright, trademarks and trade secrets. Moreover Izwi cannot be held liable if you make any unlawful use of any multimedia content accessed through the search facility provided by Izwi's network, or otherwise available through access to our network, whether for commercial or noncommercial purposes.
Any violation of the individual's right to privacy, including any effort to collect personal data of third parties without their consent.
Any fraudulent activity whatsoever, including dubious financial practices, such as pyramid schemes; the impersonation of another subscriber without their consent; or any attempt to enter into a transaction with Izwi on behalf of another subscriber without their consent.
Any violation of the exchange control laws of the Republic.
Any activity that results in the sale, transmission or distribution of pirated or illegal software.
Failing to respond to a request by a recipient of unsolicited mail to be removed from any mailing or direct marketing list and continuing to send unsolicited mail following such a request for removal.
Where any user resides outside of the Republic, permanently or temporarily, such user will be subject to the laws of the country in which s/he is currently resident and which apply. On presentation of a legal order to do so, or under obligation through an order for mutual foreign legal assistance, Izwi will assist foreign law enforcement agencies (LEA) in the investigation and prosecution of a crime committed using Izwi's resources, including the provisioning of all personal identifiable data.
The following sections outline activities that are considered an unacceptable use of Izwi's services/network/website and also detail the guidelines for acceptable use of certain facilities/services, as the case may be.
Threats to Network Security
Any activity which threatens the functioning, security and/or integrity of Izwi's network is unacceptable. This includes:
Any efforts to attempt to gain unlawful and unauthorised access to the network or circumvent any of the security measures established by Izwi for this goal;
Any effort to use Izwi's equipment to circumvent the user authentication or security of any host, network or account ("cracking" or "hacking");
Forging of any TCP-IP packet header (spoofing) or any part of the header information in an email or a newsgroup posting;
Any effort to breach or attempt to breach the security of another user or attempt to gain access to any other person's computer, software, or data without the knowledge and consent of such person;
Any activity which threatens to disrupt the service offered by Izwi through "denial of service attacks"; flooding of a network, or overloading a service or any unauthorised probes ("scanning" or "nuking") of others' networks;
Any activity which in any way threatens the security of the network by knowingly posting, transmitting, linking to or otherwise distributing any information or software which contains a virus; Trojan horse; worm, lock, mail bomb, cancelbot or other harmful, destructive or disruptive component.
Any unauthorised monitoring of data or traffic on the network without Izwi's explicit, written consent.
Any unsolicited mass mailing activity including direct marketing; spam and chain letters for commercial or other purposes, without the consent of the recipients of those mails.
Public Space and Third Party Content and sites
In reading this AUP or in signing a service contract with Izwi, you acknowledge that Izwi has no power to control the content of the information passing over the Internet and its applications, including e-mail; chat rooms; news groups; or other similar fora, and that Izwi cannot be held responsible or liable, directly or indirectly, for any of the abovementioned content, in any way for any loss or damage of any kind incurred as a result of, or in connection with your use of, or reliance on, any such content.
Our services also offer access to numerous third party webpages. You acknowledge that we exercise absolutely no control over such third party content, or sites and in such cases, our network is merely a conduit or means of access and transmission. This includes, but is not limited to, third party content contained on or accessible through the Izwi network websites and web pages or sites displayed as search results or contained within a directory of links on the Izwi network. It remains your responsibility to review and evaluate any such content, and that any and all risk associated with the use of, or reliance on, such content rests with you.
Access to public Internet spaces, such as bulletin boards, Usenet groups, chat rooms and moderated forums is entirely voluntary and at your own risk.
Izwi employees do not moderate any of these services, or your communications, transmissions or use of these services. We do not undertake any responsibility for any content contained therein, or for any breaches of your right to privacy that you may experience as a result of accessing such spaces.
The customer is responsible for determining and familiarizing himself or herself with the written policies of a given newsgroup before posting to it.
The customer must comply with these guidelines at all times which can be obtained from other users of the newsgroup upon request, or from the group's administrators/moderators.
The following are prohibited practices with regard to Usenet newsgroups and Izwi reserves the right to delete and/or cancel posts which violate the following conditions:
Excessive cross-posting of the same article to multiple newsgroups. [Some companies specify a number here and if you'd prefer to, you may well do so and advise of the cancellation of the post if such number is exceeded]
Posting of irrelevant or off-topic material to newsgroups (also known as USENET spam).
Posting binaries to a non-binary newsgroup.
Posting adverts, solicitations, or any other commercial messages unless the guidelines of the newsgroup in question explicitly permit them.
Unsolicited, Spam and Junk mail
Spam and unsolicited bulk mail are highly problematic practices. They affect the use and enjoyment of services by others and often compromise network security. Izwi will take swift and firm action against any user engaging in any of the following unacceptable practices:
Sending unsolicited bulk mail for marketing or any other purposes (political, religious or commercial) to people who have not consented to receiving such mail;
Operating or maintaining mailing lists without the express permission of all recipients listed;
Failing to promptly remove from lists invalid or undeliverable addresses or addresses of unwilling recipients or a recipient who has indicated s/he wishes to be removed from such list;
Using Izwi's service to collect responses from unsolicited e-mail sent from accounts on other Internet hosts or e-mail services, that violate this AUP or the AUP of any other Internet service provider;
Including Izwi's name in the header or by listing an IP address that belongs to Izwi in any unsolicited email whether sent through Izwi's network or not;
Izwi provides a spam and virus filtering system to protect customers from unsolicited mail and viruses. The customer acknowledges that this system might incorrectly identify a valid message as spam or as a virus and consequently this message might not be delivered to the customer. The customer acknowledges and agrees that Izwi shall without limitation have no responsibility for, or liability in respect of any data lost as a result of this system.
Izwi reserves the right to examine incoming or outgoing mail to the extent necessary to determine if it is classified as spam.
Webmail and other web based email services made available by Izwi are provided on an "as is" basis without representations, warranties or conditions of any kind, and the customer acknowledges and agrees that Izwi shall have no responsibility for, or liability in respect of, any aspect of the Webmail services, including without limitation for any lost or damaged data or any acts or omissions of Izwi. As webmail storage space is limited, some Webmail messages may not be processed due to space constraints or message limitations. Webmail is provided to individuals and for personal use only. Any unauthorised commercial use of the Webmail service, or resale of the Webmail service is expressly prohibited.
Protection of Minors
Izwi prohibits customers from using Izwi's service to harm or attempt to harm a minor, including, but not limited to, by hosting, possessing, disseminating, distributing or transmitting material that is unlawful, including child pornography.
Privacy and Confidentiality
Customers are responsible for any misuse of Izwi's services that occurs through the customer's account. It is the customer's responsibility to ensure that unauthorised persons do not gain access to or misuse Izwi's service.
Izwi urges customers not to reply to unsolicited mail or "spam", not to click on any suggested links provided in the unsolicited mail. Doing so remains the sole responsibility of the customer and Izwi cannot be held liable for the Customer being placed on any bulk mailing lists as a result.
Where the customer has authorised a minor to use any of the Izwi's services or access its websites, you accept that as the parent/legal guardian of that minor, you are fully responsible for: the online conduct of such minor; controlling the minor's access to and use of any services or websites; and the consequences of any misuse by the minor, including but not limited to transactions entered into by the minor using such access.
Izwi cannot be held liable for any business dealings you have with any third parties on the Internet, including any vendors, or advertisers found on, or through, the Izwi network. Further, Izwi assumes no responsibility whatsoever for any charges you or any user of your account incurs when making purchases or other transactions in this manner. Further, the responsibility for ensuring compliance with all applicable customs and exchange control laws in connection with any such transactions shall be the customer's.
Notice and Take-down Procedures
Izwi confirms that it has a procedure in place for the notice and take-down of illegal material. In compliance with section 77 of the Electronic Communications and Transactions Act (No. 25 of 2002) Izwi's designated agent for this process is the Internet Service Providers’ Association. ISPA can be reached at 010 500 1200 or firstname.lastname@example.org. The notice and take-down procedure can be viewed at http://www.ispa.org.za/code.
Customers are also notified of the content and procedures of the ISPA Code of Conduct which may be used against any Internet service provider who fails to comply with the code of conduct. We urge you to familiarise yourselves with this code.
Complaints and procedures
It is the customer's responsibility to familiarise himself or herself with the procedure set out below and report any cases of violation of this AUP to Izwi's designated complaints handling agent.
Please note that Izwi cannot handle complaints concerning networks or users that do not have service contracts with us or our affiliates, or are outside of our control.
In order for Izwi to thoroughly investigate the complaint and take appropriate action, all complaints must be in writing, via fax or e-mail and contain as much information as possible, including, but not limited to:
the origin of abuse or offence, including the website, full mail headers, relevant logfile extracts etc;
any contact details for the source of the complaint;
a brief explanation why the incident is considered to be an offence.
Izwi discourages anonymous complaints being made via this service, and urges complainants to supply their name and contact details to us. Such information will not be released, except where required by law enforcement. Anonymous complaints will however be acted upon as long as sufficient detail as outlined above is supplied.
Action following breach of the AUP
Upon receipt of a complaint, or having become aware of an incident, Izwi may take any of the following steps:
In the case of a network, inform the user's network administrator of the incident and request the network administrator or network owner to deal address the incident in terms of this AUP and the ISPA Code of Conduct;
In severe cases suspend access of the user's entire network until abuse can be prevented by appropriate means;
In the case of individual users, warn the user; suspend the user's account and/or revoke or cancel the user's network access privileges completely;
In all cases, charge the offending parties for administrative costs as well as for machine and human time lost due to the incident;
Assist other networks or website administrators in investigating credible suspicions of any activity listed in this AUP;
Institute civil or criminal proceedings;
Share information concerning the incident with other Internet access providers, or publish the information, and/or make available the users' details to law enforcement agencies
Reservation and Non Waiver of Rights
Izwi reserves the right to amend or alter this policy at any time, and without notice to you.
Izwi reserves the right to take action against any individuals, companies or organizations that violate any of the prohibited activities set out herein, or engage in any illegal or unlawful activity while accessing our services, to the fullest extent of the law.
Izwi reserves the right, at its sole discretion, to act against other types of abuse not listed in this document and to investigate or prevent illegal activities being committed over our network.
Izwi reserves the right to monitor user and network traffic for site security purposes and prevent any unauthorised attempts to tamper with our site or cause damage to our property.
Izwi reserves the right to suspend, revoke or cancel Izwi's services to the customer/user if the safety and integrity of Izwi's resources are placed at risk in continuing to provide service to the subscriber/user.
Izwi reserves the right to remove any information or materials in whole or in part, that, in Izwi 's sole discretion, is deemed to be offensive, indecent, or otherwise objectionable.
Izwi does not undertake to guarantee the security of any data passing through its networks. Although Izwi will provide a "best effort" service, including regular updates on computer viruses and other threats to security of data, it is the responsibility of the communicating parties to safeguard their data, and Izwi cannot be held liable for any loss or damage arising as result of the failure to do so.
Izwi does not waive its right to enforcement of this AUP at any time, or prejudice its right to take subsequent action, should Izwi fail, neglect or elect not to enforce a breach of the AUP at any time.
Our agent for the purpose of receiving take-down notifications in terms of section 75 of the Electronic Communications and Transactions Act.

Izwi respects customer privacy and the privacy of those accessing our website, or those websites hosted by us. We undertake to protect the confidentiality of our customers and users including all personal information supplied in the course of contracting with us for services. We undertake not to sell your personal information to third parties for commercial or marketing purposes.
Collection of Personal Data
Izwi collects personal data about our users when you visit a website hosted by us; apply for a service subscription; respond to a customer questionnaire; sign up for a new service and through the use of cookie technology. We may also combine information about you that we have with information we obtain from our business partners or affiliates.
Use of Personal Data
Izwi may on occasion use your personal information to contact you about promotional offers; advise you of matters relevant to service provision and in some cases, solicit your feedback. However, Izwi will provide you with an option within every communication to opt out of receiving any communications of this nature or you can contact our customer services representatives to ensure that you do not receive such promotional information, at +27-10-500-1414.
Izwi collects and shares aggregated user data with business partners, sponsors or other third parties for the purposes of developing content and ensuring relevant advertising and content, such user data will never be used to identify individual users. These business partners and affiliated companies do not have any independent right to share this information.
Izwi may log the websites you visit; collect IP addresses and information about your operating system and the type of browser you use for the purposes of network/system administration; to report aggregate information to our advertisers, and to audit the use of our site. This data however will not be used to identify individual users who will at all times remain anonymous.
Any information Izwi collects from you through correspondence with us, whether via e-mail, telephonically or by written letter, will only be used to address the matters within that correspondence. If this requires referring such correspondence within Izwi or to a third party to ensure customer service, your personal information will only be disclosed to the point necessary to address your query or concerns, and will otherwise be kept confidential.
Public Space (Bulletin Boards, Chat Rooms and Third-Party Sites)
Any information that customers disclose in a public space, including on any bulletin board, chat room or any site Izwi may host for you, is available to anyone else who visits that space. Izwi cannot safeguard any information you disclose there.
Izwi will not enter into a service subscription contract with a minor unless such minor has explicit written consent from a parent or guardian to do so. Izwi undertakes not to contact minors about promotional offers or for marketing purposes without a parental consent.
Reservation of Rights
Izwi reserves the right to disclose information about customers where required in good faith, to do so by law or to exercise our legal rights or defend ourselves against legal claims.
Izwi further reserves the right to share information with law enforcement to investigate or prevent illegal activities being committed over our network.
Izwi reserves our rights to disclose your personal information where you have given us explicit legal written consent to do so.
Izwi reserves the right to monitor user and network traffic for site security purposes and prevent any unauthorized attempts to tamper with our site or cause damage to our property.
Detailed description of goods and/or services Izwi Communications (Pty) Ltd (herein referred to as "Izwi") is an Internet service provider that markets hosting, Internet access, Communications and web development services.
Subject to availability and receipt of payment, requests will be confirmed within 2 working days and delivery confirmed telephonically or via e-mail.
By agreeing to use our services you agree to our standard terms and conditions.
Return and Refunds policy
The provision of goods and services by Izwi is subject to availability. In cases of unavailability, Izwi will refund the client in full within 30 days. Cancellation of credit card orders by the client will attract a 5% administration fee. Izwi provides a full 30-day money back guarantee on all services. All goods such as hardware and software remains the property of Izwi until paid in full.
Izwi offers a R 500.00 rebate for all equipment less than 2 years old. The rebate is paid out for complete working installation kits delivered to our offices, in Bellville, by the client. Should we need to collect the kit from the client's premises, a travel charge of R 4.00/km will be deducted from the rebate amount before payment is made.
Unless otherwise noted all prices on this web site includes Value Added Taxes (VAT). Residents from outside the Republic of South Africa are exempt from South African VAT.
Izwi shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Izwi's PAIA Manual can be downloaded from https://www.izwi.co.za/legal/paia.pdf .
Acceptable use policy
Izwi's hosting and Internet access services are government by our Acceptable Use Policy (AUP). Our AUP policy states that none of services may be utilised in any way to generate SPAM (UCE - Unsolicited Commercial E-Mail). Use of your e-mail account to send unsolicited bulk (UBE) or commercial messages (UCE) is prohibited. This includes, but is not limited to, bulk-mailing of commercial advertising, informational announcements, charity requests, petitions for signatures, and political or religious tracts. Such material may only be sent to those who have explicitly requested it. We currently do not allow P2P on our network.
Izwi's uncapped ADSL and uncapped wireless accounts will never be capped. However, our uncapped service is not designed for people using computer programs running 24/7 continuously downloading. If your intentions are to download 24/7 then these accounts are not for you. We reserve the right to shape and throttle any account whose usage are affecting other users on our network's internet experience negatively. Our main goal is to keep the majority of our clients happy so if certain individual's abusive downloading is affecting other users on our network we reserve the right to shape, throttle or cancel their service.
Fair use Policy (applicable to all Uncapped ADSL services)
The usage is monitored on a rolling 10-day period and does not reset at the beginning of each month. All service options are Unshaped. Should usage remain less than 80% of the average user for each product, the service will remain unaffected. However, should individual usage exceed 80% of the average user for each product, then the first level of moderation will be implemented, moving the service to a Shaped service. Shaping or moderation is implemented via download throttling and user relative priority control will first be applied to all file sharing protocols. Should usage remain above the 80% average threshold, additional shaping will be managed via manipulation of throttling and priority control. The 4096 Lite is managed at 50% of the average and is designed for light users who still require high speed access to the internet.
Izwi's servers may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes a legal threat, or violates export control laws. Examples of unacceptable content or links: "Pirated software", "Hackers programs or archives", "Warez Sites", "Irc Bots", "Illegal Mp3's" etc.
We will be the sole arbiters as to what constitutes a violation of this provision with guidance taken from the Internet Service Provider's Association, our governing body.
Payment options accepted
Payment may be made via Debit Order (Bank Draft) and Visa / MasterCard /American Express credit cards. Unless otherwise specified all hosting and Internet access services are payable pro-rata in advance except Uncapped ADSL products.
Izwi ‘s debit orders are processed once a month, on the first working day of each month. Should a customer's monthly debit order return as rejected for any reason, a rejection fee of R100 will incur and this will immediately be billed as a separate invoice.
Upon signing up with Izwi, the client agrees to any additional relevant charges to their products that are not included in their monthly service invoice. This includes any top up invoices generated for Internet connection, as well as traffic or disk over-usage invoices that are created for hosting. As all invoices are automatically e-mailed immediately after they are generated, it is the client's responsibility to contact Izwi should they have any queries relating to an invoice upon receipt thereof.
Credit card acquiring and security
Credit card transactions will be acquired for Izwi via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
Customer details separate from card details
Customer details will be stored by Izwi separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).
Payment via Credit card
All new orders placed where the account holder is making payment via Credit card will need to be accompanied by copies of the account holder's Credit card (front and back of the card) before the order will be processed. Should a client wish to change their payment method to Credit card, or update their Credit card details, this will also be required.
Izwi takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
Country of domicile
This website is governed by the laws of South Africa and Izwi chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
Izwi at its sole discretion, may choose to change the terms, conditions and operation of this website at any time without notice. This includes the occasional adjustment of our pricing allowing for the notification of our clients within 21 days.
Non-Payment on Overdue Invoices
All invoices - unless otherwise indicated are due COD, or by the first of each month as all monthly services are billed in advance for the upcoming month. Should an invoice become overdue, the necessary process is followed by our system with the details that are available on each client's profile. Should we receive no response with regard to outstanding invoices, the account will be handed over to our listing agency - Accountability. The client will receive notice from this company of the outstanding fees and have 30 days to respond and make arrangements for payment to Izwi. Should payment not be received after the 30 days, the account holder will be blacklisted for non-payment.
It is the responsibility of the client to ensure that Izwi has their updated details, and this is available for each client to view in their client area. It is also the responsibility of the client to be in contact with Izwi to arrange for payment before the account is handed over.
Technical Support regarding Overuse Investigation
Our hosting and Internet access platforms already provide clients with detailed statistics of usage. Sometimes clients find it difficult to understand that they are using such a large amount of overuse. If a client is unable to resolve the issue using the tools at their disposal and they would like Izwi to investigate further, our Support team will be able to assist on this matter at a charge rate of R 200 per domain / account. Charges will not be applied should there be a system fault on Izwi 's side. For further clarity on this please contact our help desk.
System Administration Support Fees Charged
Izwi charges for system administration of client servers. If we need to log a call with Parallels, a fee of $75.00 is charged to the client for each incident, and is payable upfront.
Transfer Requests Outside Office Hours
If a client wishes to transfer a domain out of office hours, the following policy applies:
If the above procedure has not been followed the after-hours (emergency personal) will be unable to help.
Please note that all outgoing domain transfers are automated. If your domain or any of the related service are not paid up to date the domain transfer will be automatically declined. Manual override can only be done during office hours.
Transfer tickets are only accepted once the cancelation for the specific hosting product has been requested online in the client area by the client, and in accordance with Izwi's 30-day notice period for hosting product cancellations.
Termination of Service
The General Terms of Service of this agreement commences on the ive Date and will continue indefinitely, subject to termination by either party on 1 (one) calendar months prior, following our online cancellation procedure.
Cancellations are accepted by completing an online cancellation request in the customer client area. Cancellations are processed as follows:

Client Contact Details
It is the client's responsibility to keep their contact details up to date. This is easily accessible via the Client Area
Izwi has standard procedures for obtaining technical support and escalations.
Clients are requested to log a ticket when experiencing difficulties. Methods for logging tickets are as follows:
When requesting technical support, you will be given a ticket number. All our technical support cases are attached to a ticket number which we use to trace the issue through our system. Without a ticket number, we cannot process any support request. Should you not receive a ticket number by default, please ensure that you ask for one. If you require to escalate a call, ensure that you quote your ticket number when proceeding with the escalation request.
Please do not contact our Support Engineers directly on their personal e-mail address or via any of the chat programmes such as GChat or WhatsApp, as your query will not be handled efficiently.
Our Support Department should not be contacted for any reason on their cell phone numbers when reporting a problem.
Our system is set up to handle all technical support queries in an efficient manner and problems will only be addressed by following one of the three reporting methods above.
Our SLA and turnaround times
The following time periods are applicable with regards to our support structure:
Within 24hrs - emergency maintenance to Izwi infrastructure such as high sites and apartment hotspots
Within 72hrs - snaglist resolution of jobs already started
Within 4 working days - maintenance and call out jobs
